GOVERNMENT OPENNESS TASK FORCE

OFFICE OF ATTORNEY GENERAL

FEBRUARY, 2003

The following list of statutes was compiled for general use by the Government Openness Task Force.  It includes the state's open meetings law and general state and federal open records laws. This list also includes specific state laws requiring that certain types of documents must be held confidential or, on the other hand, held public. This list was prepared for general use and is not intended to substitute for thorough legal research in the event of specific disputes regarding the South Dakota public information provisions.  Consequently, when relying on this list, care should be taken to also consult the statutes for the subject involved. In addition, some agencies within state government have promulgated rules covering specific types of information. These agencies include the Department of Environment and Natural Resources, the Public Utilities Commission, and others. Accordingly, the specific department rules should be consulted for more specific information regarding particular programs. The Attorney General's office has attempted to provide a complete list, but does not guarantee that every relevant SD statute has been included.
