BURNING PERMIT
A burning permit is required for any open fire within the
Black
Hills Forest Fire Protection District (state codified law
34-35-16). The Fire Management Officers located in Hot Springs, Lead, and
Rapid City will determine if conditions are favorable for burning in your

The public is advised to plan ahead and make requests for burning permits
during normal working hours which are 8 a.m. to 4:30 p.m. Monday through
Friday. Burning permits may be obtained online or by calling the toll-free
burning permit hotline.
Burning permits do not relieve the permittee of responsibility for civil
damages or costs of suppression and extinguishment should a fire escape the
control of the permittee. The permittee is also responsible for obeying all
state and federal laws and regulations defined by the state Department of
Environment and Natural Resources and the US Environmental Protection Agency
pertaining to what types of material may be burned. Burning within the
Black Hills Forest Fire Protection District without a burning permit is a
class 1 misdemeanor. A class 1 misdemeanor is defined as: Up to one year in
jail or $1,000.00 fine or both.
